1. Information about Sinqro

1.1. Legal and contact information

Sinqro Technologies, S.L. (hereinafter "Sinqro"), with address at C/ Tecnología, 17, 08840 Viladecans, Barcelona and VAT identification B66598764, is an entity duly constituted and registered in España, in the Mercantile Registry of Barcelona, in Volume 44991, folio 156, General Section, page 473517, registration 1st.

1.2. Company activity

Sinqro's activity consists of connecting every party involved in any transaction in the hospitality and food sector, providing technology and services on a transactional and SaaS (software as a service) business model.

For this, Sinqro uses a set of applications based on different technologies that it makes available to the user through web channels and as mobile applications, whose servers respond to the main domain sinqro.com. Henceforth software, servers, and channels are understood as THE PLATFORM.

2. Data protection and privacy policy

2.1. Information gathering

When the user makes use of THE PLATFORM through any of its channels — web or mobile — the data necessary to provide the service is collected and stored, except for sensitive credit card information which is NEVER stored on THE PLATFORM. Sensitive information is understood to be the full credit card number and the CVV security code. Sensitive data is stored by the bank or payment processor duly validated for that activity.

2.2. Use of cookies

A cookie is a file downloaded to your device when you access certain web pages. Cookies allow a web page to store and retrieve information about the browsing habits of a user or device. Depending on the information they contain and the way the device is used, they may be used to recognize the user. The browser memorizes cookies on the hard drive only during the current session, occupying a minimum memory space and not harming the device. Cookies do not contain specific personal information, and most of them are erased from the hard drive when the browser session ends (session cookies).

Most browsers accept cookies by default and, independently of that, allow temporary or memorized cookies to be permitted or prevented in their security settings. Without your express consent — by activating cookies in your browser — the data stored in the cookies will not be linked to the personal data provided at registration or purchase.

2.2.1. Types of cookies used by this website

• Technical cookies: required to navigate the platform and use its functions — controlling traffic and data communication, identifying the session, accessing restricted parts, remembering items in an order, completing the checkout flow, requesting registration or event participation, using security elements during navigation, storing content for video/audio playback, or sharing content via social networks.
• Personalization cookies: allow the user to access the service with predefined general characteristics based on criteria in the user's terminal — language, browser type, regional configuration, etc.
• Analytics cookies: used by us or by third parties to quantify the number of users and perform statistical analysis of how the service is used, so that we can improve the offering of products or services.
• Third-party cookies: this site may use third-party services that collect information for statistical purposes about the use of the site and for the provision of other services. In particular this site uses Google Analytics, a web analytics service provided by Google, Inc. (1600 Amphitheater Parkway, Mountain View, California 94043). These services use cookies that collect information including the user's IP address, which is transmitted, processed, and stored by Google under the terms set out on google.com, including possible transmission to third parties for legal requirements or when third parties process the information on behalf of Google.

By using this site the user expressly accepts the treatment of the information collected in the form and for the purposes indicated above, and acknowledges the possibility of rejecting the treatment of such data or information by rejecting cookies through the appropriate browser settings. Blocking cookies in the browser may prevent full use of all the website's functionalities.

2.3. Use of information

The user information collected and stored is used to provide the contracted services and to offer a better experience while using THE PLATFORM.

2.4. Communications

Sinqro will communicate with the user through any contact information previously provided by the user, distinguishing two scenarios: for transactional communications (registration, cancellation, password changes, order confirmation, balance movements, etc.) the user cannot opt out. For promotional or commercial communications the user may request unsubscription with 15 days' notice.

2.5. Changes to the privacy policy

Any changes will be published on the websites managed by Sinqro and, in some cases, sent by email to the address provided at registration.

3. Use of THE PLATFORM

3.1. Access

Access to THE PLATFORM is allowed temporarily and we reserve the right to withdraw or rectify access without prior notice. We are not responsible if, for any reason, THE PLATFORM is not available at any time or for any period. Occasionally we may restrict access to parts of THE PLATFORM, or to all of it, to registered users. The user is responsible for keeping connection details and any account activity confidential. If you suspect a problem with your connection data or that it has been misused, you must contact soporte@sinqro.com immediately. Sinqro may deactivate a user's account at any time for good cause.

3.2. Lawful use

The user may only use THE PLATFORM for lawful purposes. The user may not use THE PLATFORM in any way that implies violation of laws or regulations applicable locally, nationally, or internationally, nor may they knowingly send, receive, upload, download, use, or reuse any material that does not comply with our content standards stipulated below. The user also agrees not to access without authorization, interfere with, damage, or disturb any part of THE PLATFORM or any network or equipment used to supply THE PLATFORM.

Sinqro undertakes not to allow any transaction that is illegal, or considered illegal by the card brands or acquiring bank, that may or has the potential to damage their goodwill or influence them negatively. The following activities are prohibited under the card-brand programs: the sale or offer of any product or service not in full compliance with all laws applicable to the Buyer, Issuing Bank, Merchant, Cardholder, or cards.

3.3. Content standards

These content standards apply to all material the user contributes to THE PLATFORM and to any associated interactive services. The data provided must be real, accurate, and compliant with the applicable legislation in the country where the service is provided and any country it is published from. Contributions must not contain material that is defamatory, obscene, offensive, hateful or provocative, that promotes sexually explicit material, or that encourages violence or discrimination based on race, sex, religion, national origin, disability, sexual orientation, or age. Contributions must not infringe any copyright, database right, or trademark; must not be liable to deceive any person or be carried out in breach of a legal obligation to a third party (such as a contractual obligation or duty of trust); must not promote any illegal activity; must not threaten, invade, or abuse the privacy of others, cause unnecessary discomfort, harassment, annoyance, embarrassment, alarm, or inconvenience; must not impersonate a person or falsify identity or affiliation; and must not defend, encourage, or contribute to any illegal act, including copyright infringement or computer misuse.

3.4. Suspension

Failure to comply with this section is a serious violation and may lead us to take any or all of the following measures: immediate, temporary, or permanent withdrawal of the right to use THE PLATFORM; immediate, temporary, or permanent removal of any publication or material uploaded; posting a warning to the user; legal action including procedures for reimbursement of all costs (including, without limitation, reasonable administrative and legal costs) resulting from the infringement; and disclosure of such information to law-enforcement authorities as we deem reasonably necessary. The responses described in this clause are not limited and we may take any other action we deem reasonable.

3.5. Intellectual property rights

We own or hold a license for all intellectual property rights of THE PLATFORM, as well as the material published on it. These contents are protected by intellectual-property laws and treaties worldwide. All such rights are reserved. The user may not copy, reproduce, re-edit, download, publish, broadcast, transmit, make available to the public, or in any other way use any content of our site, by any means, except for their own personal, non-commercial use.

3.6. Changes to THE PLATFORM

We try to update THE PLATFORM regularly and may change the content at any time. If necessary we may suspend access to THE PLATFORM or close it indefinitely. Any material published on THE PLATFORM may expire at a given point and we assume no obligation to update such material.

3.7. Uploading material to our site and THE PLATFORM

Any material the user uploads to THE PLATFORM will be considered non-confidential and non-private, and the user acknowledges and accepts that Sinqro has the right to use, copy, distribute, sell, and disclose such material to third parties for any purpose linked to our economic activity. To the extent the material is protected by intellectual-property rights, the user grants Sinqro a perpetual, worldwide, royalty-free license to use, copy, modify, distribute, sell, and disclose such material or information to third parties for any purpose related to our economic activity.

3.8. Links from THE PLATFORM

Regarding any links to other websites and resources provided by third parties that THE PLATFORM may contain, these links are provided for informational purposes only. We have no control over the contents of those sites or resources and we assume no responsibility for them or for any loss or damage that may arise from your use of them.
